Sure, laws and regulations on firearms purchases have been developed from it, but numerous events indicate their effectiveness is minimal.<\/p>\n<p>Now that it&#8217;s 72 hours after a 20-year-old whacko killed his gun-loving mother and took her guns to a <a title=\"Google News search on &quot;Newtown School Shooting&quot;\" href=\"https:\/\/www.google.com\/#q=Newtown+School+Shooting&amp;hl=en&amp;tbo=d&amp;source=lnms&amp;tbm=nws&amp;sa=X&amp;ei=5oTOUObLBc7JqQHhjoCgDA&amp;sqi=2&amp;ved=0CAoQ_AUoAA&amp;bav=on.2,or.r_gc.r_pw.r_qf.&amp;bvm=bv.1355325884,d.b2U&amp;fp=ff8d60e2935e5575&amp;bpcl=39967673&amp;biw=1005&amp;bih=509\" target=\"_blank\" rel=\"noopener\">nearby grade school<\/a>, killed 20 young children, six adults then shot himself in the head, we pinkos (as <a title=\"When Republicans Were Blue and Democrats Were Red\" href=\"http:\/\/www.smithsonianmag.com\/history-archaeology\/When-Republicans-Were-Blue-and-Democrats-Were-Red-176776491.html\" target=\"_blank\" rel=\"noopener\">opposed<\/a> to the reddies and the bluesers) should admit that maybe Newtown couldn&#8217;t have been prevented. Mama Whack owned the weaponry, apparently legally. Twenty Whack&#8217;s issues probably didn&#8217;t look that threatening, before Dec. 14.<\/p>\n<p>We can&#8217;t arrest someone before a crime; <a title=\"&quot;Real-Life &quot;Minority Report&quot; Program Gets a Try-Out&quot;\" href=\"http:\/\/www.cbsnews.com\/2100-503063_162-20117207.html\" target=\"_blank\" rel=\"noopener\"><em>Minority Report<\/em><\/a> is science fiction. For a few more years.<\/p>\n<p>But quickly and decisively revising who gets to possess which kinds of arms can have an impact on the enraged\u00a0 attitude of &#8220;I&#8217;ll Show Them.&#8221; Other countries have whackos &#8212; <a title=\"Norwegian Court Finds Man Sane Who Admitted Killing 77 People in Summer 2011 When He Bombed Central Oslo Then Fired at Island Youth Camp\" href=\"http:\/\/www.bbc.co.uk\/news\/world-europe-19365616\" target=\"_blank\" rel=\"noopener\">Norway<\/a> and <a title=\"China School KNIFE Attack in Henan INJURES 22 children\" href=\"http:\/\/www.bbc.co.uk\/news\/world-asia-china-20723910\" target=\"_blank\" rel=\"noopener\">China<\/a> are recent examples &#8212; but with America, second place is no contest. The explanation: Other countries control weapons more stringently.<\/p>\n<p>Revising a mental health care system will take longer than a couple of months. Mainstreaming the emotionally dysfunctional decades ago was intended to curb cruel, ineffective practices. Exchanging one extreme for the other causes its own failures <a title=\"Navigating the Mentally Ill Away from Jail\" href=\"http:\/\/www.cnn.com\/2012\/08\/21\/health\/mental-health-navigator\/index.html\" target=\"_blank\" rel=\"noopener\">too often<\/a>.<\/p>\n<p>In short, let&#8217;s not <a title=\"&quot;Do Not Fight the Last War&quot; -- No. 2 of The 33 Strategies of War\" href=\"http:\/\/en.wikipedia.org\/wiki\/The_33_Strategies_of_War\" target=\"_blank\" rel=\"noopener\">fight the last war<\/a>.<\/p>\n<p>We did not stop Twenty-Whack or the other dozens of Yankee psycho shoot-em-ups of recent years.<\/p>\n<p>Let&#8217;s plan for the next war.<\/p>\n<p>We start by setting fire to the <a title=\"Straw Man, or Aunt Sally\" href=\"http:\/\/en.wikipedia.org\/wiki\/Straw_man\" target=\"_blank\" rel=\"noopener\">Straw Man,<\/a> in this circumstance, the Second Amendment.<\/p>\n<p>Here&#8217;s the old sentence itself, straight from the quill <a title=\"The Bill of Rights\" href=\"http:\/\/billofrightsinstitute.org\/founding-documents\/bill-of-rights\/\" target=\"_blank\" rel=\"noopener\">pen<\/a> of Little Jimmy Madison:<\/p>\n<blockquote><p>A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.&#8221;<\/p><\/blockquote>\n<p>Not even the First Amendment has had the same kind of liberty over the centuries: Courts give freedom of religion, speech, press, peaceful assembly and petition a nearly limitless <a title=\"The Bill of Rights\" href=\"http:\/\/billofrightsinstitute.org\/founding-documents\/bill-of-rights\/\" target=\"_blank\" rel=\"noopener\">berth<\/a>. But these tolerate some boundaries.<\/p>\n<blockquote><p>Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.&#8221;<\/p><\/blockquote>\n<p>What are the constraints on the First Amendment? There are any number of relatively specific limits and expansions (watch the double negatives, legal beagles), such as the recent <a title=\"&quot;Summary of Citizens United v. Federal Election Commission&quot;\" href=\"http:\/\/www.cga.ct.gov\/2010\/rpt\/2010-R-0124.htm\" target=\"_blank\" rel=\"noopener\"><em>Citizens United<\/em><\/a> case allowing corporations freedom of speech with which to support or vilify political candidates.<\/p>\n<p>Yet there remains a sweeping Freedom of Speech impediment, and a comparable stumbling block needs to be set before the foot of the Second Amendment. &#8220;FIRE!&#8221;<\/p>\n<p>Nearly a century ago the U.S. Supreme Court ruled unanimously that the First Amendment does not protect against maliciously causing a panic.<\/p>\n<p>Americans do not have the right to create a &#8220;clear and present danger,&#8221; said Justice Oliver Wendell Holmes Jr., writing for the court. His sentence: &#8220;The most stringent protection of free speech would not protect a man falsely <a title=\"Shouting fire in a crowded theater, from Schenck v. United States, 1919\" href=\"http:\/\/en.wikipedia.org\/wiki\/Shouting_fire_in_a_crowded_theater\" target=\"_blank\" rel=\"noopener\">shouting fire in a theater<\/a> and causing a panic.&#8221;<\/p>\n<p>The Constitution and its Amendments comprise a living document. This case, <a title=\"Schenck v. United States, 1919\" href=\"http:\/\/en.wikipedia.org\/wiki\/Schenck_v._United_States\" target=\"_blank\" rel=\"noopener\"><em>Schenk v. United States<\/em><\/a>, seems overly limiting to civil liberties. In fact the ruling was overturned 50 years later in <em><a title=\"Brandenburg v. Ohio, 1969 -- Unlike sports, where Ohio often wins\" href=\"http:\/\/en.wikipedia.org\/wiki\/Brandenburg_v._Ohio\" target=\"_blank\" rel=\"noopener\">Brandenburg v. Ohio<\/a><\/em>. But the &#8220;shouting fire&#8221; example holds.<\/p>\n<p>The Constitution gains its strength from being reconfigured for each era. That&#8217;s why the <a title=\"The Bill of Rights\" href=\"http:\/\/billofrightsinstitute.org\/founding-documents\/bill-of-rights\/\" target=\"_blank\" rel=\"noopener\">Third<\/a> Amendment has been ignored:<\/p>\n<blockquote><p>No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.&#8221;<\/p><\/blockquote>\n<p>If there is a limit to extraordinarily reckless or malicious speech, in causing panics or riots, why can&#8217;t a liberty loving republic control the violent possibilities of reckless or malicious people?<\/p>\n<p>Have you noticed? I am no lawyer.<\/p>\n<p>But our nation can&#8217;t keep handicapping itself with laws that don&#8217;t actually exist. State Guard units have nada to do with owning firearms for marksmanship, personal protection and for hunting. The best that 18-century guns could fire was <a title=\"History Channel: Authoritative but informal 4 minute video on muskets\" href=\"http:\/\/www.history.com\/videos\/musket-loading-how-fast#musket-loading-how-fast\" target=\"_blank\" rel=\"noopener\">three shots a minute<\/a>. Since then, the number of people hurt and killed by <a title=\"Gun Control Issues, Public Health, and Safety\" href=\"http:\/\/library.med.utah.edu\/WebPath\/TUTORIAL\/GUNS\/GUNSTAT.html\" target=\"_blank\" rel=\"noopener\">gun mishaps<\/a> is heartbreaking.<\/p>\n<p>We can help the irrationally violent better than we have been. (By help I mean hinder them.) We can control weapons to a greater degree. We must.<\/p>\n<p style=\"text-align: right;\">Copyright 2012 Ben S.
